RESSOCIALIZAÇÃO MEDIADA PELA ASSISTÊNCIA RELIGIOSA: DIREITO DOS ENCARCERADOS NO SISTEMA PENITENCIÁRIO

Abstract

The object of study of this dissertation is restricted to the re-socialization of ex-prisoners made possible by religiosity. There is no way to speak of ex-detainee without tracing from his life in a house of detention to the return to freedom in a society marked by discrimination and repugnance when in contact with other people. Faced with the difficulty of social confrontation of the former detainee, this research investigated the possibility of religious assistance inside and outside the prisons with a view to resocialization of this class. The objective was to point out indispensable adjustments so that religious assistance is a viable and effective practice in the penitentiary complexes of the country and in the life of the ex-prisoner. In addition to demonstrating the reality of these units, it was elucidated in what circumstances the religious agents assist prisoners, the difficulties faced in this endeavor, although this practice is supported by federal legislation. It was discussed some national and international experiences that sought success in this practice, its positive and negative points and the adjustments that need to be made, proposing to this end the privatization of prisons in the Public-Private Partnership (PPP) model, including in its project the viability of religious assistance to be effectively effected both in the behavioral change of the prisoner and in the preparation for the prudent confrontation of the ex-detainee in social life in the midst of all kinds of discrimination. It was stressed that the establishment of PPPs does not exempt the State from certain inalienable functions. The justification of the research is formed in three levels, namely: i) academic, with the expansion of the theoretical collection on the subject, which allows new research; ii) social, for the significant information that is available to the reader who is interested in this social problem; iii) personal, for fostering the reflective-critical thinking in the researcher himself and inciting curiosity to deepen the subject. The study was based, initially, on an exploratory methodology involved in the bibliographic survey, starting from there for a descriptive and finally explanatory research. It was based on a theoretical framework pertinent to the penitentiary system, legal issues and religious assistance. It was concluded that, in the face of the imminent bankruptcy of the Brazilian prison system, PPPs (combined with effective, regular and uninterrupted religious assistance, that is, the distressed and the ex-offended) are the alternative that has not yet been tested , but which could change the fate of an invisible clientele while imprisoned and repudiated as a social entity.
