A CULTURA JUDAICO-CRISTÃ E SUA RELAÇÃO COM OS DIREITOS FUNDAMENTAIS PREVISTOS NA CONSTITUIÇÃO FEDERAL DE 1988

Abstract

This dissertation proposes to examine the existence of regulatory elements provided in the Torah absorbed by the Judeo-Christian culture found in texts on fundamental rights in the wake of the 1988 Federal Constitution and constitutional legislation. The goal is to outline a study of the formation of the Hebrew laws, identifying its normative aspects, its relation with the Mesopotamian laws and their absorption and rereading by Christianity. Fundamental rights proposal is to investigate the evolution and the relationship of its origin and mutation with the Judeo-Christian culture, especially the remarkable presence of canon law, all from a hermeneutic analysis. With regard to Brazilian law, it shall seek to establish a relationship between the text of fundamental right under the Federal Constitution of 1988 and the infra law with the Judeo-Christian culture, in the form of comparative law by bringing to light the legal elements arranged in Pentateuch.
